In this action for damages allegedly resulting from defects in the design and construction of its city hall, plaintiff, City of Westminster, appeals from a judgment in favor of defendants, MOA, Inc. (MOA), Carrier Corporation, and Parker Electronics, Inc. (Carrier/Parker). Westminster settled its claims with certain other defendants before the filing of this appeal, and the claims against the general contractor and its surety and the general contractors cross-appeal were settled subsequent to the filing of the appeal. We reverse and remand for a new trial.
